4 yearly review of modern awards – Professional Diving Industry (Industrial) Award – substantive issues – hours of work and payment of overtime for inshore divers.

A. Further to decisions [[2020] FWCFB 2792] and [[2020] FWCFB 5672] issued by the Full Bench on 28 May 2020 and 26 October 2020, the above award is varied as follows:

1. By deleting clause 30.1(a) and inserting the following:

(a) in excess of 7 hours and 36 minutes per day; or

B. This determination comes into operation from 9 November 2020. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 9 November 2020.
