Application for approval of the The Village Roadshow Theme Parks - MEAA Entertainers Agreement 2010.
[1] An application has been made for approval of an enterprise agreement known as the Village Roadshow Theme Parks - MEAA Entertainers Agreement 2010 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). The Agreement is a single-enterprise agreement.
[2] I am satisfied that each of the requirements of ss186, 187 and 188 as are relevant to this application for approval have been met. In this respect I note that the Warner Bros Movie World - M.E.A.A. Entertainers Award 2001 1 is the relevant award for the application of the better off overall test. This is an enterprise award and I note it contains a multi-hiring clause and a banking of hours in similar terms as this enterprise agreement. For this reason I accepted the submissions of both the employer and the Media, Entertainment and Arts Alliance (MEAA) the test was satisfied.
[3] Written undertakings concerning clauses 5.1.6 and 8.2 have been provided by the employer and they are taken to be terms of the Agreement. A copy of the undertakings is attached in Annexure A.
[4] The MEAA, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. As required by s.201(2) I note that the Agreement covers the organisation.
[5] The Agreement is approved. In accordance with s.54(1) it will operate from 26 July 2010. The nominal expiry date of the Agreement is 1 June 2012.
