A scope order defines which employer(s) and employees are covered by a proposed single-enterprise agreement. If a bargaining representative has concerns about the bargaining process, they can apply for a scope order using Form F31.

Who can use this form
Only use this form if you are:
- a bargaining representative for a proposed single-enterprise agreement
And you have:
- already given your concerns in writing to the relevant bargaining representatives for the agreement AND
- already given the relevant bargaining representatives a reasonable time to respond AND
- not received an appropriate response.
You cannot apply if there is a single interest employer authorisation in place for the agreement.
Before you start
Have this information ready before you begin. You will need to give or tell us:
- your details
- your organisation's details (if applying on behalf of an organisation)
- your representative's details, such as a lawyer or paid agent (if you are using one)
- details of the person or business you want the order against (the 'respondent')
- details of the group of employees you want the scope order to cover
- proof that you are meeting, or have met, the good faith bargaining requirements
- how the order will help make the bargaining process fair and efficient
- a copy of the written notice of concerns you gave the other bargaining representative(s).

Send us your application form and a copy of your written concerns about the scope of the proposed agreement.
Email your documents to lodge@fwc.gov.au. You can also send or deliver your documents to the Commission office near you.
What happens next
You must send (serve) a copy of your application to each respondent listed in the application.
After we receive your application, we will contact you to explain the next steps in the process.
