If an enterprise agreement does not meet the requirements of the Fair Work Act, we may approve the agreement with an amendment.
Content
Agreements must meet the requirements in the Fair Work Act 2009. If we are concerned that the agreement does not pass the better off overall test, we may amend the agreement to address the concern.
Representatives provide feedback
If we intend to amend an enterprise agreement, we will seek the views of:
- the employer or employers that are covered by the agreement;
- the employees who are covered by the agreement; and
- bargaining representatives for the agreement.
