We may make an alternative protected rate of pay order for labour hire employees covered by a regulated labour hire arrangement order if it would be unreasonable to pay them the protected pay rate set by the host employment instrument. Use Form F86D to apply.

Who can use this form
Only use Form F86D if you are:
- a regulated employee who is covered by the regulated labour hire arrangement order or proposed regulated labour hire arrangement order
- an employer that is covered by the regulated labour hire arrangement order or proposed regulated labour hire arrangement order
- the regulated host, or
- an employee organisation or employer organisation that is entitled to represent the industrial interests of any of the above.

Before you start
Have this information ready before you start the Form F86D. You will need to tell us:
- your contact details
- your representative’s contact details (if you have one)
- details of
- the regulated labour hire arrangement order or application for an order, including case number
- the regulated host, employer, regulated employees and employee organisations
- the work performed by the regulated employees
- the covered employment instrument to be specified in the proposed alternative protected rate of pay order, and
- reasons why the Commission should make the order.
