For some applications, you must pay a fee when you apply. If you are in serious hardship, you can ask us to waive the fee.
You need to pay a fee when you ask us to deal with:
- unfair dismissal (Form F2)
- general protections involving dismissal (Form F8)
- general protections not involving dismissal (Form F8C)
- an unlawful termination dispute (Form F9)
- an order to stop bullying(Form F72)
- an order to stop sexual harassment that commenced prior to 6 March 2023 (Form F72A)
- a dispute about unfair contract terms (Form F91).
The fee for 2024-25 is $87.20. This changes on 1 July each year.
How to pay
You can pay by credit card or cheque or money order when you apply by post or in person. We will contact you for payment by credit card if you have not paid.
If you cannot pay
If you have serious financial hardship, you can ask us to waive the fee. Complete the waiver of application fee form and send it with your application.
Refunds
For unfair dismissal applications, general protections and unlawful termination applications
For unfair dismissal applications, general protections and unlawful termination applications, we will refund your fee if you ask us to stop the case:
- before we set a date for a conference, or
- at least 2 days before the listed date if we have set a date for a conference.
For stop bullying or sexual harassment applications
For applications for the Commission to stop bullying or sexual harassment in connection with work, we will refund your fee if you ask us to stop the case before we set a date for a conference or hearing.

For credit card payments, we refund the same credit card, usually within a week.
If you paid by cheque or with a now-expired credit card, we issue a bank cheque, usually within 6 weeks.
