The Commission must still decide any applications for extension made before 7 December 2023.
If you made an application before 7 December 2023 to extend the default period for a ‘zombie agreement’ and the application had not been decided by that date, the Commission must still decide the application.
Download our List of pre-2010 agreements – extended or pending extension application (xlsx) for a list of pre-2010 agreements that have had their default period extended by the Commission or are subject to an application to extend the default period currently before the Commission.
For a list of all extension application decisions issued by the Commission see Zombie agreements extended past 7 December 2023
If the Commission decides to refuse the extension, the Commission must extend the default period until the later of:
- the end of the day of the refusal decision, or
- such later day specified in the refusal decision (that is not more than 14 days after the day the refusal decision is made).
Any decision will be taken to have been made immediately before 7 December 2023.
