Who can use this form
Use Form F97 if you are lodging this declaration with Form F96 – Application to vary a collective agreement.
This declaration must be completed together by:
- the regulated business, and
- the registered organisation (like a union)
covered by the collective agreement.
Before you start
Have this information ready before you start.
You will need tell us:
- basic details of the collective agreement as proposed to be varied, such as its name and the class of regulated workers it covers
- details of the entities covered by the collective agreement as proposed to be varied
- details of the persons making the declaration on behalf of entities covered by the collective agreement as proposed to be varied
- steps taken to explain the collective agreement as proposed to be varied to the regulated workers covered by the collective agreement as proposed to be varied
- whether there are any minimum standards orders in operation that cover the same regulated workers as the collective agreement as proposed to be varied
- how the terms of those minimum standards orders (if any) compare to the terms of the collective agreement as proposed to be varied.

What happens next
We will undertake an assessment of the variation of the collective agreement on the information and material provided.
We will also publish a copy of this declaration on our website if your collective agreement is varied in accordance with Section 536MU(2) of the Fair Work Act.
