Who can use this form
Use this form if you are:
- a registered organisation (like a union), or
- a regulated business
covered by the collective agreement.
Before you start
Have this information ready before you start.
You will need to give us:
- contact details for the regulated business and the registered organisation covered by the collective agreement
- basic details of the collective agreement as proposed to be varied, such as its name and the class of regulated workers it covers
- an explanation as to why the variation of the collective agreement would not be contrary to the public interest.
When you submit this application form, you will also need to provide us with:
- a signed copy of the collective agreement as proposed to be varied, and
- Form F97 – Declaration in support of an application to vary a collective agreement.

- a signed copy of the collective agreement as proposed to be varied, and
- Form F97 declaration
to lodge@fwc.gov.au.
You can also send or deliver your application to the Commission office near you.
What happens next
As soon as possible after you lodge the application, you must send (serve) a copy of this application and any accompanying documents on the other entity that is covered by the collective agreement.
We will undertake an assessment of the variation of the collective agreement on the information and material provided.
