Introduction
The Australian Retailers Association has applied to change the General Retail Industry Award 2020. The Fair Work Commission has also commenced proceedings to change the Award.
Content
The application by the Australian Retailers Association has been made under section 158 of the Fair Work Act 2009 (AM2024/9). It seeks to vary multiple clauses in the General Retail Industry Award 2020 intended to improve award flexibility and to clarify entitlements.
In August 2024, the Fair Work Commission commenced its own proceedings (AM2024/33) to consider proposals to vary the Award advanced in the making awards easier to use stream of the Modern Awards Review 2023-24. The Commission has decided to hear and determine AM2024/33 together with the outstanding matters in AM2024/9.
Previously, the Fair Work Commission commenced proceedings under section 160 of the Fair Work Act 2009 (AM2023/17) to vary the Award. AM2023/17 is now closed (see [2024] FWCFB 197).
